bus accident

You may have seen the story last week of an incident where a school bus ended up on its left side and ended up in the median. Luckily, no students were on the bus, but this accident affected more than just two vehicles that day. It all started when a car was hit as it changed lanes as it attempted an unsafe lane change. It then struck a second vehicle, whose driver lost control and veered two lanes over into the bus.

Once the bus was struck, the bus driver lost control and made a sharp right turn, driving into a concrete divider then crossing all of the lanes of traffic before overturning in a grass median. A fourth vehicle attempting to evade the accident ended up in the same median as the overturned bus.

Somehow, nobody involved sustained any major injuries. At the Law Office of Dorothy Hyde, we know that this incident could have been much worse. We think it shows how dangerous the roadways can be even if a person is driving completely safely. If you need a Dallas bus accident attorney, you can count on us.

Number For Our State

This accident really could have been devastating. If that bus had been full of students, the injury count would likely have been much higher, especially when you consider that most bus occupants are not restrained in their seats. The bus driver was not at fault. The fault here was with the car who made an unsafe lane change.

So many accidents in this state are caused by driver error. Often this includes drivers who are distracted or impaired. Reckless decisions that drivers make have severe consequences. We know that the Texas DOT gives us the statistics for the latest reporting year:

  • 254,853 people injured in accidents
  • 14,299 people sustained serious injuries
  • 3,721 fatalities due to crashes

The injuries sustained in these accidents cost people and their families dearly, especially when insurance companies do not offer enough to cover all of the expenses. In an accident, medical expenses are just part of the overall costs. Most people do not consider what happens to a family if the accident victim is the main income earner and can no longer work. They also do not factor in harder to determine costs like pain and suffering damages.

It is not something we think about on a regular basis, but when a bus crash occurs, it usually catches our attention. That is because of the potential for each crash to turn into a multiple casualty event. That is exactly what happened in 2016 when nine people were killed and 40 injured in a 2016 Texas bus crash.

Now, the National Transportation Safety Board has released its final report and has determined that the bus driver was suffering from “acute sleep deficit” and this contributed to the crash. They found that the bus left the road and rolled when the driver overcorrected and slammed on the brakes.

The NTSB also found that the bus had inoperable antilock brakes.

At the Law office of Dorothy Hyde, this incident and the final report show the two major causes of bus accidents – driver error and vehicle malfunction. You need to know where to turn if you are injured in a bus crash so you can get fair compensation for your expenses. If you need a Dallas bus accident lawyer, call us today.

What Can Happen?

You probably do not even think twice about a bus accident each time you pass a bus in our area, but have you stopped to think about just how many buses we have around here?

  • Public transportation buses
  • Long-distance passenger buses
  • School buses

There are thousands of buses in our area that work to move people to and from their destinations each day. We know that these are large vehicles that weigh tens of thousands of pounds. When a bus crashes, it is a danger to its passengers as well as anyone around the vehicle. Injuries can be severe.

Many bus accidents happen due to vehicle failure. All it takes is one thing to go wrong for a driver to lose control of the vehicle. This can include a problem with a tire or wheel, the powertrain, brakes, suspension, or more. For that reason, regular inspections and maintenance by the bus companies are vital.

We also know that bus drivers should always operate responsibly. They should never operate under the influence of drugs or alcohol. Doing so jeopardizes the safety of the passengers and anyone on the roadway around the bus. We also know that drivers should not operate while distracted or fatigued, as they will be much more likely to cause a crash.

We need to bring you a tragic story that happened earlier this month in nearby Mesquite. A 12-year-old girl and other students were injured when the school bus they were on rolled into a ditch and caught fire.

“It is with a very heavy heart that we must confirm that today, we lost one student,” a statement from the district said.

Three other students were hospitalized out of the 42 on board. The rest were taken back to school to be reunited with their families. Three officers who worked to pull students from the bus were also treated for smoke inhalation.

As of yet, the cause of the crash has not been determined.

We know that the last thing you think about when you say goodbye to your kids each day is the possibility that they will get hurt. There can be nothing scarier than getting a phone call and someone telling you that your child has been in an accident.

Do you know what to do if this happens to you? If you need a Dallas bus accident attorney, you can count on the Law Office of Dorothy Hyde.

Major Incidents

There are more than just school buses on Dallas roadways. Think about how many you see on a daily basis. From long-distance transportation buses to the many DART buses, we are surrounded by bus options. Thousands of people use them each day.

But they can also be the cause of major accidents.

Companies and Drivers

It is up to bus companies and agencies to regularly inspect and maintain their vehicles. If they do not, a failure on any part of the bus can cause the driver to lose control. Accidents commonly occur in larger vehicles due to failure on the part of tires or wheels, the brakes, the steering, or the powertrain.

Bus drivers should also be trained to drive each vehicle they are asked to operate. They should never drive while they are distracted by their phones or other devices. They should also never operate while impaired by drugs or alcohol.

Buses are large vehicles that have the ability to cause a mass casualty incident. Remember, most places do not require bus passengers to wear seat belts.

What You Can Do

We know how scary bus accidents can be. We also know that you may be dealing with injuries that can make it hard to focus on the financial aspects of your life. We do not think you should not have to suffer financially because of someone else’s negligence.

When you need a bus accident attorney in Dallas, you can count on the Law Office of Dorothy Hyde. We will work to secure the compensation you deserve for your accident-related expenses. Buses are an excellent resource for Dallas residents. They offer a cheap alternative to get around town without much hassle. In fact, an estimated 250,000 people will ride Dallas’s public transportation system every day.

However, for as convenient as they are, buses can also be very dangerous because they are large vehicles that are difficult to maneuver in busy Dallas streets. Unfortunately, bus accidents may occur more than you realize, and when they happen, they could affect dozens of passengers. In these situations, you need a Dallas bus accident lawyer to fight for your rights.

Special Rules Apply to Bus Accidents in Texas

Unlike private passenger vehicles, buses are often operated by public entities. That includes the Dallas Area Rapid Transit (DART) system. Some specific rules and regulations apply to claims for accidents or injuries on public transportation. You must be aware of these rules and follow them carefully to start your legal claim. Thankfully, a Dallas bus accident attorney will keep track of deadlines and procedural requirements for you.

1. Notice Periods

Most personal injury cases, such as car accidents or slip and fall incidents, have a two-year time limitation to file your claim. That means that you have two years from the date of your injury to file your lawsuit. However, claims against the government, including public transit, have a much shorter notice requirement that you must use.

The government must receive notice of your claim within six months after the date that it occurs. However, cities are also allowed to enact a shorter notice time period as well. Dallas, as well as several other major cities in Texas, use a 90-day timeframe to receive notice. That means that if you do not provide notice to the City of Dallas of your claim within 90 days of the date of the incident, you may lose your right to start a claim at all.

2. Damage Caps

In addition to shorten notice periods, claims against the state government and municipalities after a bus accident are subject to maximum recovery amounts for certain types of damages. In particular, damages for physical injuries are limited to $250,000 per person and $500,000 per accident. There are also limitations for property damage as well.

Local government limitations are even lower: $100,000 per person and $300,000 per claim. In many bus accidents, the local government limitations will come into play. In the case of a DART accident, however, restrictions that affect “municipalities” will apply.

3. More Than Just Collisions

It is a common misconception that bus accident claims only apply when a bus collides with another vehicle or an object. You can still assert a claim against DART or busing company if you are injured on a bus for any reason. You may also be able to start a lawsuit if you were harmed while getting on or off a bus as well. In fact, some of these minor injuries are more common than those caused by collisions.

If you have been involved in a bus accident, you may have a legal claim. Get a free case evaluation with our firm by calling 214-883-1700.
