HOW TO AVOID TRAPS IN THE CLAIMS HANDLING PROCESS

1. Make sure that you have all of the necessary information before you contact your insurance company to report a claim- including date of loss, time and location; driver’s name, address, telephone number and drivers license number; vehicle make, model and license plate number; city of police department, police report number and when the report will be available.

2. If the police report is available, obtain a copy of the report and forward to the insurance company.

3. Advise your insurance company of the auto accident, even if you are not at fault.

4. Advise the insurance company of the at fault driver.

5. Be prepared when speaking to the insurance company.

6. Answer only the questions asked by the insurance company representative.

7. Do not volunteer any information.

8. Do not agree to a recorded statement without the benefit of counsel.

9. Know the value of the repairs on the vehicle. If the vehicle is a total, go to www.kbb.com to obtain information about the value of the vehicle.

10. Take pictures of your vehicle and save the pictures.

11. If needed, promptly seek medical attention at the hospital, personal physician or a clinic.

12. If you do not know of a clinic who treats auto accident victims, contact Dorothy M. Hyde at 214.234.0730 or 214.883.1700 for a free referral.

13. Document your injuries; take pictures of cuts and bruises.

14. Document time missed from work for later submission of lost-wage reimbursement.

15. If you need counsel, seek assistance early to avoid mistakes that may result in the claim being denied or unfair settlement offers.

THINGS THAT COULD HAPPEN IN THE PERSONAL INJURY CLAIMS PROCESS

1. The insurance company could drag it’s feet in investigating the claim and accepting responsibility (typical).

2. The person at fault may not report the accident to their insurance company.

3. The person at fault may not have coverage for the damage that they caused you. If so, you may have to file a claim on your insurance policy; if you do not have full coverage, you may have no recourse.

4. Your car could cost more to repair than it is worth, and you may have to obtain new transportation.

5. You may have paid to much for your car, with sales price and financing, and if your car is a total, you may become “upside down” in the value versus the loan amount due.

6. You may not own the car and the bank may lien the title if the payments are not current.

7. You may not have purchased Guaranteed Auto Protection (GAP) insurance if you are “upside down” on the value of the vehicle.

8. You may not have purchased Uninsured and Under Insured Motorist protection (UM/UIM).

9. You may take time away from your ordinary schedule with making doctor appointments in order to feel better and by documenting your injuries.

10. You may have to make a commitment to your health and recovery by keeping your doctor appointments, even if it is time consuming.
